D.C. Judge Seeks $67 Million for Lost Pants

District Courthouse signHow does one quantify enjoyment gained from the perfect pair of pants? A flattering fit, oh-so-crisp lines or fine-woven fabrics might make trousers priceless to their owner. Roy L. Pearson, Jr., who just happens to be an administrative law judge for the District, doesn't have a problem putting a price on such clothes. He believes his pants are worth $67 million.

Pearson alleges Custom Cleaners in Northeast lost his trousers back in 2005. He filed a lawsuit seeking damages and claiming the city's consumer protection laws were violated. The cleaners said they gave the him the proper pants, but offered the judge a $12,000 settlement anyway. He refused and pressed on with the case, which Chris Manning, attorney for Custom Cleaners, calls, "possibly the most amazing example of frivolous and ridiculous litigation."

A glance at Judge Pearson's bio reveals no clues to whether he's crazy enough to think a jury would award him such a hefty sum. For almost 25 years he worked with an organization that provides, "civil legal assistance to indigent residents of the District of Columbia," -- surely a worthy cause. We'll have to wait until June, when the complaint is scheduled to appear in court, and see if the case leads to a windfall for victims of sartorial mistaken identity everywhere.

$67 million huh? Cleaners lost my shirt last year and all I got was a $50 credit, I need to sharpen my bargaining skills. With all the times the cleaners have lost or damaged my clothing I could have retired to the south of france years ago.

Its crazy and so is this Lawyer. He should be sued for being stupid. This is why our judical system is broken and he is a big part of it. He should be disbarred and put in a mental care facility.

What a shame that just when we had such high hopes for the new Fenty administration to help curb crime in the District it turns out a member of his own administration is attempting to commit the biggest theft in the history of the city with a ridiculous and frivolous $65 mil law suit against what seems to be an honest, hard working, legal immigrant. It would seem obvious that since Pearson is this much of a crook that a simple background check may be in order here…

 

What in the world does this have to do with Fenty? The lawsuit stems from an incident in 2005.

 

As an Administrative Law Judge, Pearson represents the District both professionally and personally. That’s why employers (especially gov) do periodic background checks. Would you want this nut on your payroll?

 

It seems to me like the pants are a symptom of a larger issue -- respect. Apparently, the judge wants to prove a point about being treated a particular way at a business he patronizes. Even more apparently, the business owners don't really care about his patronage and would rather he just go away. Personally, I think he should take the hint. You can't MAKE people respect you. You can't MAKE people sorry they disrespected you. You CAN make people hate your guts.

 

This is bull crap. Pearson's a damn jerk. what goes around comes around, i hope the Chung's family counter sue his ass for 100 million dollars.

As of May 2, 2007, he's no longer working for the DC government. A call to the mayor's call center 202-727.1000 confirms this.

 

I read in another story that his pants were eventually found but he refuses to accept them back. The opposing counsel intends to present them to him in the courtroom.

 

can a local business protest against him and no service to roy pearson. there are alot of business with "satisfaction guaranteed". He can make any reason to suit any other business. someone should make a post "Most unwanted" with picture and post every business place in DC.

 

This guy is representing our "justice" system??? This is insane! It seems to me that this guy lost control of his temper and decided to put these poor people through hell. I doubt he cares so much about his pants as sinking their dreams and their lives in the process, knowing of the tremendous cost of a defense. I'm no legal expert, but couldn't the cleaners counter sue for the turmoil and money lost? They have been WAY MORE than fair in their offers.

I wish I were a lawyer so I could do a little pro bono work for these poor people.

There was NO STAIN; the pants were at the cleaners TO BE ALTERED. The pants were altered and found a week later and this numnuts was told they were found. They (the cleaners) even offered to settle, but this bonehead ALJ (who's QUITE full of himself and his little title) decided that he would show what a "formidable" African-American lawyer he was said, "No!" The "man" is extremely offensive to me on THREE fronts: 1)as a member of the legal community; 2) as an African-American, and 3)as an American. What an a**hole!!!

 

His pants were not found. The dry-cleaners presented Pearson a gray pair of pants, claiming to be his. But Pearson claims his pants were navy with red stripes. Wouldn't that piss someone off? First they lose the pants, second they refuse to pay for them and third they lie by claiming the cheap gray pants were his client's pants. Please, they should be put out of business.

 

And one more thing...they only offered to settle after being sued and finding out that the client was a judge (at their lawyer's advice). They would not have given him a dime if he didn't sue. They are not as innocent as you all might think.

 

I guess his head has become too big for the pants to fit.

Um, isn't it pretty obvious that "LJ" is Judge Pearson? As in "Law Judge"? (Guess he dropped the "Administrative.") I mean, only this nutball himself would (A) know about the ins and outs of the case and the timing of the suit, and (B) defend the behavior of said nutball. That's why they should be put out of business. Capitalism would be a monstrous animal without these lawsuits that protect customers from being screwed by big or small businesses alike. If it were not for these lawsuits, we would all be given cow piss instead of organic milk. Sure you all pity the small Korean family business, but the principle is the same. Whether it's McDonald's or Ford or any other company that screws its customers one way or another. I worked at a dry cleaner when I was a teenager and boy did I encounter some uppity patrons. There was this one guy who was NEVER happy with the way his pants were pressed and ALWAYS requested a repress, free cleanings etc. I wondered why he didn't just go to another cleaner. Maybe it was because another locale would have been inconvenient for him but then again he could of have just sued for 10 yrs worth of rental car fees like Mr. Pearson is.

 

LJ - Did you finish grade school? You should know there is a difference between suing for missing pants and suing for finding poison in our cereal. Missing pants will not end your life but poison would. Your rational that the koreans should be placed out of business for missing pants tells me you didn't finish 6th grade. Ever heard of "the punishment should fit the crime?" Oh wait, you didn't go that far in school. Sorry...for you.

 

I have to say it is sad for these people this is happening but this is exactly what needs to be done because customer service has been a joke for these businesses and somebody needs to take care of these issues if the better business bureau and the government is not doing something about it. It looks like superman is in DC and is taking care of business.
These business owners need to respect and serve these poor customers that do not have the time, the energy, the knowledge to deal with their foolishness. Finally someone who knows what he is doing legally is getting down to business and guess what I hope we have more and more people like this fine gentlemen fighting for their rights as a consumer who actually PAY for service that is usually mediocre.

I am also black, and I don't like it that these Koreans that work hard. I would rather see a black man get them for what the white people did to my race. Narcissism IS a treatable condition, as long as you take responsibility for your behavior that is. I'd encourage a couple of folks here to consider what their life would be like if they were actually happy.

 

I think LJ is right in the sense that the Koreans involved are not innocent.

That said, the punishment doesn't fit the crime. If you don't like the service, you don't need lawyers...just don't go there. If no one goes there and the service sucks...they will go bankrupt.

This lawyer is using laws designed to help consumers get fair judgements as a tool for personal vengeance. He knows that this family doesn't have the money or insurance....but he doesn't care. He is creating litigation to force this family into bankruptcy. More litigation, more attorney fees, and lucky him...he's a lawyer so he doesn't pay the same fees.

Given the racial composition of the DC jury pool, he'll probably win this case and get some kind of award. My best guess, he'll walk away with $30,000. Very few things can protect you from a race-biasd jury.

 

As a former member of the DDR Ministry for State Security(Stasi for you Americans), I tell you this, we actively used and recruited the legal system in America and the west to bring your country to its knees. Certainly the Chungs, who by all accounts are a hard working, naturalized Korean-American couple do not have the means to satisfy a $ 67 million judgment from their assets or from the proceeds of any business insurance policy they might have. It's unlikely that Judge Roy "Bean" Pearson traces his lineage to a pear, but by his attempt to anihilate the Chungs he may very well come from a long line of sons of bitches. Even taking into account, his manifestation of obsessive compulsive disorder, probable trouser fetish, and being an all around USDA Prime Cut A-hole, his compensatory damages couldn't possibly exceed $2,000. And that would still be a huge windfall to Hizdishoner. When the Chungs offered him $12 grand, before his legal shakedown of these poor people hit the news, he should have run with it. No, the only motive that Hangin' Judge Roy can have is either an intense hatred towards the Chungs, or perhaps Koreans, or perhaps legal immigrants. In any event, Judge Roy's actions demonstrate the most vile, malice aforethought. Hopefully the laundry owners have countersued for the intentional infliction of emotional distress by this fetid piece of human detritus, held together by a black robe. This repugnant excuse for a human being and abhorrent mockery of the justice system, has plumbed new abysmal depths of judicial intemperance. Hopefully, justice will prevail for the Chungs and the judge hearing this case will order Pearson to pay the Chungs all of their legal fees and costs, and very reasonably, $100,000 in punitive damages for his malicious attempts to destroy them, when at most, they have done nothing more than lose a a crummy pair of pants. And that's even doubtful, since news accounts quote the Chungs as having located the pants, with the claim ticket shortly after they were presumed lost, but Pearson refuses to accept them. Hmmmm.....hard to tell who to believe, people who offer $12,000 for a lost pair of pants, or a character who demands $67 million for those pants? Needless to say, if the District of Columbia keeps this sociopath in its employ as an arbiter of its local "justice" system, that whole system is as twisted as this louse. Since Judge Roy had been wearing the pants, they should have been burned anyway, to prevent spread of whatever inhuman pestilence controls his mind and spirit. He makes a mockery of consumer protection, and words can not adequately describe his evil opportunism. The only thing that would make this story more repulsive, is if a jury hears this case, and awards Pearson anything more than whatever his suit cost new, particularly if the perception is simply that the jury "liked" Pearson more than the Chungs.

 

This DISHONORABLE "judge" is a joke! I can't even call him a "judge" because it saddens me to think the District has empowered a pathetic human being like Roy L. I read that the dry-cleaners found his pants a few days later - with the same ticket number on his receipt, and with measurements matching exactly his other pants/himself. Articles mentioned they offered him money for his "troubles"..I believe $3,000, up to $12,000! I DESPISE people like him and it makes Americans look ridiculous! How pathetic! I sincerely hope these poor dry-cleaners will counter-sue and put him in bankruptcy - I'm sure he's not far from it - that's why he's pulling a ridiculous stunt like this.

Pearson seems like the type of person to pardon human error and give the dry cleaners a chance or a few days to look for the pants? I'm sure he screamed at them from the start and threw a tantrum, threatening to sue because of the "customer guaranteed" sign in the window - looking for any excuse to extort money (which we know he tried to do with his own wife). Of course, it's speculation on my part, but I've seen miserable people like him, screaming at poor hard-working people, just trying to do their job. Does LJ seriously think , these people took the time and effort to seek out similar size pants, place on a new tag with matching numbers from his original claim form (can they even do that? i've seen forms from my cleaners and they're all preprinted) and pass it off as his original pants? Maybe Roy L. Pearson Jr is that dumb, but from the sound of it, these hard-working dry-cleaners are not. Especially presenting the wrong pants to a volatile person like that - I'm sure they wouldn't have even dared to "pull a stunt" like that.

It's reported the cleaners tried to offer him money several times, and that they found his pants he brought in (maybe it's not the pants he THOUGHT he brought in) and obviously offered it back to him, but he refused. My whole office feels sad for this cleaners and are seriously considering bringing our clothes to them to help their business, or even sending money. We, as Americans, should put together a fund for this poor family as a show of good-will that not all Americans are as pathetic as R. Pearson Jr. [I know this is a long post, but people like him make me SO mad - that STUPID and PATHETIC imbeciles like him are allowed to waste other people's precious time and tax dollars, as well as exploit innocent hard-workers. There are so many more important issues upon which this District should focus. I think Pearson Jr. is a major disgrace to America and it's people. He needs to be removed from office immediately. If the DC justice system actually allows him to win this case and serve another 10 years, then that verifys that our justice system is indeed unbalanced, corrupt, and biased. He is obviously abusing his power as a judge, and should not be allowed to get away with this. Also, I can't help but say it, he seriously needs to grow up and act like a man. I thought temper tantrums were for children.

Let me get this right....Judge takes pants to cleaners....Judge says he did not get pants back....but cleaners says he did get the pants back but decided to settle with the judge for 12k in a previous law suit. Judge refused the settlement....and is now suing for 67M for the "lost" pants. Is that about right? I don't know what this judge thinks he was putting in the pants when he had them that make them so expensive now. It definitely wasn't the brains he has been sitting on...no matter I have the pair he's looking for and will gladly return them for a lot less money. This judge has got to be out of his gord, and his superiors have to be in the same category as he is to allow him to remain on the bench deciding cases. What ever happened to the wisdom of Solomon? It has been misplaced by this judge FOR SURE!

I stumbled upon this site initially. Now, I return occasionally to see how outrageous the posts are. I've told friends...

Is this site some kind of hoax? The work of one person creating posts of vicious disrespect for the residents of the District?

 

Like the Chungs', our family came to the US to live and to pursue the American dream.

Being a dry cleaner is tough to say the least; 12 hour days, 6 days a week, being on your feet running around all day and those 120 degree summer days..
We all pitched in to work, I was 10 and my siblings were younger. Can't recall summer vacation or a free Saturday watching the toons as a kid.
As hard as it was, that was our price to pay and we paid it gladly. This is the greatest country in the world.

We were robbed more than a few times at gun point like so many of the small business owners. I still remember how I felt at 12 seeing my parent being held up.

This sack of shit is no better than those lowlife scums. He has the biggest gun of all pointing at the Chungs', it's the Tort system.

This is a sad day for all Americans.

my judge didn't enforce proper service of court documents and found me guilty by default cause I was absent. (I was suppoed to be served 5 days befor court-that would have given me an oppportunity to appear.)

Judges make mistakes and find people guilty, give in appropriate sentences. Give unfair breaks to the rich and famous... maybe we should audit the Afirmative actions and disbar any judge or attorney who has made a mistake.

Roy pearson will win the case for sure. Judge Roy Pearson lost his favorite pants, and he deserves the $67 million.
He is the judge, he can do anything.

I understand that this case is about two years old. We know what kind of judge brought this case (one with apparently little respect for the reasonable adminsitration of justice). But, based on the reports of this case in the news, I want to know what kind of judge has let this obviously frivolous case linger for two years in the system (a judge with little respect for judicial economy and no apparent ability to control over her of her docket) This is such a waste of supposedly valuable judicial resources. What was Chief Judge Tyrone Butler doing to supervise his judges, assuming that he knew about this scandalous abuse of the judicial system by an ALJ. ALJ Pearson clearly has not exhibited sound judgment. The appearance of this abuse of judgment should require a systematic review of all ALJ Pearson's decisions because they are all now suspect since ALJ Pearson has acted so intemperately and injudicidously for two years. This conduct by Pearson and by the court that let this fiasco continue fosters disrespect for the judiciary and lack of confidence in the courts.

I think we are too harsh on this Judge. I mean this Judge is clearly insane. His action toward his divorce case as well as this incident with the dry cleaner is an obvious sign that he's not capable of making sound and plausible decision. We already had a insane shooter in Virginia Tech. I hope we don't end up with a shooter in the court room. Let's get Judge Pearson committed immediatly and lock him up and throw away the room.

On May 31, 2007, D.C. Administrative Law Judge, Roy L. Pearson, filed a Pre-Trial Brief in the Pearson v. Chung dry cleaner case. In the brief, Pearson shifts the focus of his claims from his allegedly lost pants to claims related to signage in the Chungs’ store. One sign reads “Satisfaction Guaranteed” and another reads “Same Day Service.” Pearson claims the signs are somehow misleading and apparently continues to seek over $54,000,000 in damages from the Chungs. Pearson had previously sought $67,000,000 in compensation from the Chungs.

Christopher Manning, of the law firm Manning & Sossamon in Washington D.C., represents the Chungs and made the following statement in response to Pearson's recent actions:

"Although it is always encouraging to see claims withdrawn, it is simply baffling that Mr. Pearson continues to assert that he is entitled to tens of millions of dollars as a result of two completely harmless, completely straight-forward signs. Mr. Pearson's claims are not founded in common sense and are extraordinarily abusive towards the Chungs. As a result, the Chungs' terrible ordeal continues. The Chungs' decision to move to and build a business in America began with the classic American dream. Mr. Pearson has turned that dream into an American nightmare."

Mr. Pearson's lawsuit has cost the Chungs tens of thousands of dollars in defense costs. Donations to a defense fund set up by the Chungs may be made at www.customcleanersdefensefund.com.
This case will be tried in courtroom 415 of the District of Columbia Superior Courthouse on June 11th and 12th beginning at 9:30am each day.

Simple solution, counter sue for 6 billion. Its that stupid! For every day this goes to court charge the judge what the tax payers are paying to support the trial. And when it comes to decision making ability.... terminate him!

Okay, I started reading the story on my Comcast homepage and just tripped out because the man was crying in court. I had to read more on the case so I googled the subject and found this site. I must say that I am very shocked at the least.

I have read every single comment on this page and certain ones I still cannot block out or understand.

 

1. Where did race become an issue in this case?

I understand that you have an asian and black involved, but the actions of the Judge have nothing to do with his ethnic background in this situation. If you want to penalize him for filing a stupid ass case, be my guest! But it sounds a lot more racist to tag a whole group of people for one mans action.

2. Why do some believe that blacks have a thing against asians?

For starters, any problem that I have with any person should reflect what they are doing, not who they are. Now in case someone else can tell me different, asian and chinese individuals have a great impact on the black community.

Meaning, when I need a hair care product or even hair itself (lol), where do you think I go? MONEY SPENT. If I need my nails done, MONEY SPENT. If I want some chinese food, MONEY SPENT.

Where is the love for these establishments in every other neighborhood? White, Jewish, Chaldean, Mexican, Arab, etc. If a tension is felt so much, then there are plenty of cities and townships to relocate to. Are you gettin the picture? THERE IS NO APPARENT PROBLEM THAT I SEE

Maybe there is an confunsion among some, because we interact with their communities more than any other race. When you venture into urban neighborhoods, there is a constant flow of all of the places I mentioned everywhere. If the black people in general did have a problem with them,(asian, etc.)then they would not reep the profits in such large numbers from blacks.

Now I am speaking for myself which I want to make perfectly clear. I can say that I do not like when you are constantly watched when entering a store. It has gotten alot better over the years, but there still is a presence of not being comfortable. Switching to another language is also something that I do not care for, but accept. It seems that you are hiding something or talking about someone when that is done.

Now I will say that you are always more comfortable speaking in your first language. So it bothers me when I hear: If your in America, you better speak English. That is not fair of people to say, but it is alot more professional when dealing with customers.

I think racial tension exists between all races to some extent, some more pronounced than others. But I think circumstances, such as social dynamics or economics, have more to do with this than people's character.

Having said that, this lunacy of gazillion dollar lawsuit does not have anything to do with race. This simply has to do with complete lack of common sense and outrageous vindictiveness aimed at ruining other people's lives.

Pearson is just one man. He does not represent anyone but his atrocious self. He is a human garbage, him and him alone.

You place an emphasis on how blacks spend money and the asians reep profits...this may be true, but you have to admit that blacks and asians seem to have a counterdependance. Asians invest a lot of sweat and energy, not to mention huge sums of money on keeping their establishments full with inventory to supply their customers with their needs/wants. In return, customers purchase these items with their hard earned money ...is there any problem it that? Absolutely not. However, the problem begins with issues..some that you have commented on.
Just because you spend your money at a business does not give you the license to abuse people who own it or work there.You complain about how you are uncomfortable being watched upon entering an establishment, but did you ever think from the other's perspective? Do you think we actually enjoy having to watch everyone that walks through the door, or that we like to be in fear of what confrontations we may face on a day to day basis? (you know u ladies/gents can talk n confront!) Customers yell and curse that we're watching them or that we treat them like thieves, but they have no idea how many times we have been victims of shoplifters. I'm not saying all (we do have great, kind and caring regulars), but some, ranging from employees, kids, adults, to families (there was once an incident where the grandma and daughter kept us busy chatting while the granddaugher did the deed) that we have caught shoplifting. We watch every one and every thing that is in our stores. What we're doing is protecting our property and it is our right. It is not a personal attack on you, it is a way of protecting ourselves. We have to deal with picking up messes that customers leave behind, empty packets being found, and verbal and/or physical confrontations.
Black communities in the past have acted as if they have a right to mistreat store owners because we are immigrants and our parent didn't speak english; they had no way of fighting back. Well, now their children, who are educated and speaks english fluently, are taking over the business. Although we try to run it differently , we face similar challenges that they faced...only we can approach it better and react accordingly.

As to us speaking our first language, that is just comfortable and our culture/tradition. It is improper to speak to your elders or spouse in english if you know how to speak your language. Or...we could be warning eachother that we have to watch that person..but either way, if you're not doing anything wrong, it shouldn't matter if we say one thing or another.

Now, my intentions were not to debate or argue, it is my opinion that we (blacks, whites, asians, etc.) have to try to understand the other's perspective/position...or at least repect one another as human beings.
Last, if you don't like the way an establishment is run, don't use their services~! If the service is that bad, they'll go out of business eventually. There are some customers who'll never be satisfied with my service...my smile, my attitude, whatever they can find to complain about, and I've requested them to find another place for their needs, but eventually they do come back. They won't complain for a while...but then it starts again. I appreciate your business, but not THAT much...not so much that I'll take your abuse, thank you very much!

As an experienced criminal law attorney, I would have him try on the pants. "If the pants fit, then he must quit."

 

If anyone is dumb enough to think this piece of garbage is a Judge they would have to be as nuts as he is. Why has he not been fired and put in an a nut house. I would give a years pay to be the Judge over his case and you can sure bet he would no longer have a pair of pants to his name and with no pants his judge days would be over. Sure would love to pick up a news paper and read that he lost the case and everything he owns was given to the couple and a month later he was crippled from the neck down and everyone treating him was Asian. Hope he croaks soon.

If I were the judge in this case, I would rule in favor of the Chungs, and I would order Mr. Pearson and his lawyer to pay all of the legal defense fees that the Chungs have incurred throughout this entire Cluster****! Mr. Pearson would pay half of the legal fees, and his lawyer would pay the other half of the legal fees. I would also order Mr. Pearson to never return to Custom Cleaners again. This is why our judicial system is so slow and screwed up. The system does not filter out these ridiculous lawsuits, and allows them to proceed into the courtroom. This causes more important cases like the Zacharias Musohwie trial to take 4 years or more to complete. I am sure that I mispelled his name but, I do not give a ****! He does not deserve the respect! What is really ridiculous is the fact that some Americans in this country want the terrorists to be brought to the United States, in order to stand trial for their murderous crimes, even though they are not citizens of the Unites States. If we think that the judicial System is really slow now, wait until they are all brought to this country to stand trial. Remember, the Judicial System in this country is the inherent right of every LEGAL Citizen to utilize in a reasonable and professional manor. And as for those of you who question why white people allegedly do not like black people, which is mostly not true. This is case so ridiculous that it is not even a case. My GOD a pair of pants! The judge only needs to read the dictionary under "JUSTICE"-Fairness;also:righteousness. More than ample restitution was offered. Was there any intentional harm or malice? "MY GOD" it's a pair of pants that was misplaced or lost.
The judge on the bench even concidering such an amount for judgment makes me wonder if he has any better grasp on reality than the one filing suit.
Give the man the amount to replace the whole suit and then make him pay the cleaners for all of the wasted time and expense, pay ALL the court cost and pay me for my wasted time thinking about this issue. I think I can suit for a few million just because this is so STUPID. YEA someone should pay me a "STUPID TAX" on this issue.
