@Jane Flyoverstate

If it makes you feel any better there are plenty of dopes that live on both coasts that statement could apply to as well. The problem isn't really the "fly over states", but any numb skull that keeps taking the bait and voting for leaders based on stupid-ass wedge issues like gun control, religion, and immigration.

"However, you didn't really answer my question about how to get Joe Flyoverstate to recognize what's going on and what the problem is. Saying that he should "read the Constitution" isn't a solution for someone who doesn't have the education and/or analytical skills to put the whole situation into perspective."

Just because we live in a flyover state doesn't mean we're ignorant hillbillies. Midwest states provide a great education to their students and I resent your implication that we're a bunch of rednecks that wouldn't know an intellectual debate if it whacked us in the forehead.

@regentrifydc

Your screen name tells me all I need to know about you. Hate yourself much?

If you think that being Black is some sort of magic armor that protects you from the vagaries of DC bureaucracy, you're sadly mistaken. And if you think that White people don't get over with gov't bureaucrats in DC, I'm here to tell you that you're wrong about that too.

This delightful stupid ignorant racist blacks in DC government takes the fucking cake. A blanket statement that every DC gov't employee is Black, stupid, ignorant, and racist? Yeah, that's an opinion worth considering.

hillrat writes: "I know White people hate hearing about their privilege; it makes them uncomfortable and forces them to think about things they would rather not think about it, but it's a fact of life. Just like it's a fact of life that when I'm talking to a cop, if I want to continue living I'd best choose my words and actions very carefully."

Hillrat - you live in DC? Are you unaware that the majority of DC government, cops, beaurocrats, etc. are black? You obviously haven't had the privilege of being a non-black person trying to get a permit to do anything in this city while dealing with the delightful stupid ignorant racist blacks in DC government who take great joy in blithely ignoring any and all legitimate requests from non-blacks, while fawning over any black person making same request or perhaps even requesting something illegal.

DC is an absurd place for a black person to complain about white privilege.

hilrat says: As a Black man, when the cops ask/tell me to do something I get to steppin'. I don't ask any questions or point out how wrong they are, I just do what I'm told and hope to avoid a Rodney King-style beatdown or a Prince Jones-style getting my ass filled with more hot lead than a pencil.

Maybe he'll be intrigued to learn that as a non-black man (not white or hispanic or asian either - but mixed race - you know, like a human - I also know what it is to confront a jackass cop and to know that the only thing to do is to act like a door mat and hope the m'f'er doesn't fill me with lead.

Only, interesting thing is that in MY experience it's always with the black cops who act like total jackoffs. Is it a coincidence that I recentlly had a run in with one of the most ignorant megalomaniacs I ever hope to meet - who happened to be a US Park cop - and - low and behold - a black one at that. He was big, fat, stupid, arrogant, abrasive and abusive. And I got the sneaking suspician he didn't like me because he THOUGHT I am white - even though I'm not.

Aint racism grand? Combine it with most excellent stupidity and you've got game fer sure!

@McFernis

I've read the Constitution and do realize that much of what has gone down during the past administration (and much of the last 100 years) is blatantly unconstitutional. That much we can agree on, but the Constitution was designed to be a living document; subject to being changed and reinterpreted as necessary.

However, you didn't really answer my question about how to get Joe Flyoverstate to recognize what's going on and what the problem is. Saying that he should "read the Constitution" isn't a solution for someone who doesn't have the education and/or analytical skills to put the whole situation into perspective.

So allow me to rephrase my question: how do you propose we counter the visceral appeals made by sleazy politicians that are specifically tailored to play on people's ignorance and fear?

My apologies, my mind skipped there for a moment. In reference to Full Faith and Credit: Should Supreme Court rule this to mean that each State must honor the standings and rulings in each other State, this is where Full Faith and Credit would become an entanglemnt. The current view held by the Supreme Court provides no entanglement in that regard.

Hillrat

Per the Constitution and subsequent rulings by the Supreme Court, the regulation of morality and safety is a power granted to the State, not to the Federal government. As drug use is both a matter of morality and safety, I feel the individual States should be responsible for determining the legallity of "drugs" in their borders. However, the Full Faith and Credit Issue becomes an entanglement. The Supreme Court has upheld that Full Faith and Credit simply means no citizen of one State is to be treated in a lesser manner than an individual than citizens of the State they are currently visiting.

In reference to the erosion of our Constitutional Rights, I would encourage the "everyday Citizen" to go to a library (or online) and read the Constitution of the United States. Read the various Amendments later added. See for themselves what was laid down as the governing powers of the Government, and see how they have been misused and abused. An educated people is the greatest enemy of the State - for they have the knowledge of what should be, & by gaining an understanding, they are often entitled the will to change things.

Terrorism, like Communism, is the current means by which an oppressive and fearful government maintains power. McCarthy used the accusation of an individual being a Communist or Communist sympathizer in the 50s to ruin many lives. The current accusation of being unpatriotic, or of being a Terrorist/Terrorist Sympathizer is the new form of control. Same result, different time, different name.

I won't go into lengthy exposition on the uselessness of the Media, and my desire for a return of Journalism - as that is a bit off topic.

Sufficed to say, Awareness one has Rights, Knowledge of those Rights, and an Understanding of when your Rights are being denied or taken, is the best way to improve on the current decline. (And no, I am not trying to sell a book)

If I was there, I would have shown those Park Police what Jefferson meant by the right to bear arms. Two dead cops would send a message that liberty still means something to Americans.

And that sort of threat is why they break up these sorts of gatherings. Kind of a catch-22, eh?

@McFernis

Where do you think drug testing fits in under these losses of freedom?

Also, what would you propose we do about this erosion of our Constitutional rights? People are shit-in-their-pants scared of terrorism (previously it was "drugs") and have rolled over for the gov't when they want to restrict freedoms. How would address Joe & Jane Flyoverstate on these issues?

I am a fan of all the Amendments, save the 18th. And when one pays attention to the court system, the legal precendent being set by judges around the country, you come to find many of our core rights have already been damaged.

Freedom of Speech and the Press may be quelled for Corporate Interests and for the "National Security Blanket." Also, you are permitted to hate people (barely), but you aren't allowed to say you hate people - thats a no-no now.
Freedom to peaceably assemble (current issue): Well you can peaceably assemble so long as you don't do it near anyone that might be offended by your message.
Right to a Speedy and Public Trial: As a result of the Patriot Act and the current administration, there are American citizens that have been unlawfully detained for months on end, without an official declaration of charges and without the right to speak with an attorney.
Cruel and Unusual Punishment: Torture is permitted and condoned by the current administration - but they don't call it torture.
Due Process (V Amendment and ): Corporate interests may have you property seized by local and state authorities to be used by the corporation for a purpose which generates larger tax-revenues, and is therefore better for the State. This applies, as this are multi-national corporations in these instances, which comes under Article One, Section 8 of the Constitution.
Due Process and Equal Protection under law (XIV Amendment): All U.S. citizens have equal rights, except those that are homosexual.
Search and Seizure: You may have your property seized and never returned, and if you are lucky, you might even be told why (in a year or two) they took your stuff.
The Right to Bear Arms: Currently being decided, but an opinion by the Judges that "people" in this Amendment doesn't actually mean the "people" (like it does everyone else in the Constitution) - but instead means the State, would have severe damaging effects to our rights (The Bill of Rights would suddenly be for the States).

Losses of major freedoms are preceed by what is perceived to be acceptable losses of minor freedoms. The government (run mostly by power-hungry individuals) no longer fears the people, as was intended by our founding fathers. It has become the opposite, and they would be very disappointed.

dancing douchebags is the perfect description. if they were truly just dancing around in "celebration of TJ birthday" then they would have lodged their initial displeasure with the park police, as they walked out and taken it up later.

but to invent a scene complete with dismissive "read the walls" whining in the background in a ridiculous attempt to change the minds of the officers just highlights the dire need for attention.

should they have been allowed to "dance in celebration"....maybe. at midnight? sadly in this day and age, probably not. after refusing the park police express directions to leave? sorry...end of decision matrix...just laugh it off and take it up later.

Remember - your rights are only important if you're using them seriously!

Not really, but the flip side of having a right is responsibility. Just like the right to free speech is abridged by the responsibility to not shout, "Fire!" in a crowded theater. Maybe people should reserve their outrage over the right to peaceably assemble being abrogated for something a little more important than smart ass college students dancing at the Jefferson Memorial and baiting stupid cops into arresting them.

I understand your overall point, Rat, but apparently you manage to always get the white racist cops. That, in a very progressive city with a majority black police force.

I didn't mention White racist cops at all. In fact, in the last couple of high-profile questionable police shootings most of the cops have been Black. The guy that shot Prince Jones was Black and like 3 of the 5 cops that shot that guy up in New York the day before his wedding were Black too. I'll refer you to the words of Ice Cube in "Fuck tha Police":

But don't let it be a black and a white one
Cause they'll slam ya down to the street top
Black police showing out for the white cop

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances."

Okay, so which part of that is not as important as "marching for civil rights?" The right of the people to peaceably assemble. This is the core of all forms of demonstration - including the marching for civil rights.

Well, I'm sure that the First Amendment Absolutist Society (FAtAS) will be happy to know you're willing to join. Tell me - are you going to start by protesting this? Or restrictions on your ability to petition the government for redress of grievances? Or the application of the Lemon Test to determine inappropriate government entanglement with religion (because, MAN, it says "no law," like how hard is that to understand)? Or will you protest speech codes at universities that receive some public funding?

Because your coherent point of view will certainly be an asset.

They were being quite loud and disruptive. You could really hear the squeaking of their shoes echo. Trying to make a public show and a youtube video is not appropriate for a memorial and it takes away from other people enjoyment. Personal liberty ends when you encroach on someone else's liberty.

Oh this will be all over reason magazine. The female suspect was a former contributor to boot. I met Brooke once and was impressed with her intelligence and her devotion to fighting the DC smoking ban on principal. (She was a non smoker then.) Point is, despite the implicit jackasshattery involved in dancing at a monument at midnight while wearing headphones, she isn't just some stupid drunk GW kid. She's an intelligent and principled person with questionable dancing skills and judgment. Free speech, yeah, yeah yeah, but there are typically restrictions allowed for time, place, and manner of speech. If a teenage tourist did this at 2 pm, we wouldn't be having this non-conversation.

Hillman, the "Religion" card hadn't been played, so I wasn't going to open that can of worms. Also the subject of heterosexuality and homosexuality also wasn't mentioned, so I figured I'd keep that out of the mix as well.

I think the point everyone is making is the scary step things are taking. The Jefferson Memorial (per its own website) is open 24 hours a day, 7 days a week. I am sure 10 years ago, the activity of the other evening would have gone without problem. In the "Post-apocalyptic-they-are-coming-for-us-everyone-is-out-to-blow-up-America" time we live, any group gathering is going to be questioned by "fear," not by rationality.

All these policies are being put into place (and have been put into place) under the guise of providing a little security at the cost of a little liberty. And even the Founding Fathers were opposed to such an idea...

Thoſe who would give up Essential Liberty to purchaſe a little Temporary Safety, deſerve neither Liberty nor Safety." - Stated by Benjamin Franklin in letter, but not necessary of his devising.

"The payoff of addressing educational and workforce development obstacles, according to Smith: A growing tax base, reduced social services and child-poverty costs, and a significant improvement in the ability of children and D.C. Public Schools to succeed."

You forgot overwhelmingly Christian and straight.

Yes, I know, Jefferson and a couple others were more deistic, but by and large they were almost all at least public Christians, and apparently had no problem with the laws most new states had condemning gay people to death.

"I definately agree that, as a Black person, I wouldn't dare try my luck and confront the officer in that type of situation. The cards are NOT in my favor."

Have you ever actually been to the Jefferson? Perhaps the most under-surveillance spot in town. Do you really think you are going to get your ass cop-kicked on that much video surveillance? If you did, you'd end up being the YouTube superstar of the year.

And, um, at least one of the cops in question looked like a black female. So I'm not real sure that we can play a race card here.

You probably have a completely valid point on a back road in Alabama.

But, really, with a black cop on the steps of the Jefferson?

Okay, so which part of that is not as important as "marching for civil rights?" The right of the people to peaceably assemble. This is the core of all forms of demonstration - including the marching for civil rights.

Every protest, every refusal to move from a public place, every attempt to get something through the thick skulls in the Congress and Senate, starts with the right of the people peaceably to assemble. And if assembling in Celebration is not condoned, will assembly in protest be as protected?

And since "race" has already been brought up, lets address it. Yes, the Constitution, and all the rights it gives to the people - and all the powers it denies the government, was put together by land-owning, slave-owning, white, educated men. And for the longest time, the narrow scope of many people felt it should be limited to only protecting those very people.

Fortunately the country has matured since these days (for the most part, sure there are racists, and supremists ON ALL SIDES), but the beauty of the country is that they are entitled to live and die here, hate and love here, and peaceably assemble here.

Aren't there small wooden signs at the memorials (Lincoln and Jefferson) which say "Silence and Respect"? These people may be respectful but definitely not silent, so the Park Police can certainly ask them to leave. If you don't like to be removed when dancing at the Jefferson Memorial, you should start a movement to remove the signs first. You can't change the rule of the game during the game, in my opinion.

Yeah, yeah the police overreacted. But in their defense:

1. The park closes at midnight, so they actually didn’t have a right to be there.

2. The kid with the camera was a world class douchebag. It is obvious the only reason they went there was to try and aggravate the cops to overreact so they could launch into their Ron Paulesque tirades.

"My point is that the desire to challenge cops, over what is IMHO a total non-issue, is strictly the province of White people and more specifically, college educated White people that enjoy the social privilege that goes with their education."

Wuite often that's the case.

But in DC the cop is considerably more likely to be black. And anecdotally I've noticed a fair number cops much more permissive of the antics of black citizens than they are of whites.

I understand your overall point, Rat, but apparently you manage to always get the white racist cops. That, in a very progressive city with a majority black police force.

@demonfafa

No doubt you can't read (just jokes) because if you could, you would have seen I also wrote, "Were the cops wrong? Of course they were . . ."

I'm not saying these kids weren't totally within their rights to be at the Jefferson Memorial doing what they were doing. My point is that the desire to challenge cops, over what is IMHO a total non-issue, is strictly the province of White people and more specifically, college educated White people that enjoy the social privilege that goes with their education.

I know White people hate hearing about their privilege; it makes them uncomfortable and forces them to think about things they would rather not think about it, but it's a fact of life. Just like it's a fact of life that when I'm talking to a cop, if I want to continue living I'd best choose my words and actions very carefully.

However Rangers are on duty to answer questions from 9:30 am to 11:30 pm daily.' But maybe that is why the Park Rangers wouldn't answer any of their questions, since it was past 11:30pm...

I'm gonna go ahead and inject race into this discussion, because it seems like only White people just openly defy the police and basically beg to be arrested like this over some nonsense like Jefferson's birthday. I listened to the video and the guy with the camera is saying how this isn't the America that Jefferson envisioned and he's right; if we had the America that Jefferson envisioned I would still be a member of the "Motisa tribe" and bringing Monkey and Hillman goblets of Carlo Rossi on demand.

As a Black man, when the cops ask/tell me to do something I get to steppin'. I don't ask any questions or point out how wrong they are, I just do what I'm told and hope to avoid a Rodney King-style beatdown or a Prince Jones-style getting my ass filled with more hot lead than a pencil.

Were the cops wrong? Of course they were; but everyone knows that if you fuck with the bull, you get the horns.

I appreciate the midnight dancing, really. But technically, doesn't the mall "close" at 11:30PM? (in the same way parks everywhere are open dawn to dusk). (http://www.nps.gov/thje/planyourvisit/hours.htm)

I mean, technically, the officer was within his rights, as they were trespassing.

PR-wise, though, perhaps not the wisest choice.

Later, the Park Policeman invited himself over to her apartment for an apres-arrest nightcap, showing a blantant disregard for her third amendment rights.
