Obama Birth Certificate Protest at SCOTUS

Four days ago, Roger Bredow uploaded a video to YouTube beseeching like-minded people to come to Washington, D.C. and stand with him outside the Supreme Court. "[Barack] Obama was born a dual citizen," Bredow said, "British, and a citizen of the United States, at birth." This, said Bredow, meant that the president-elect could never take the oath of office. And on Friday, the Supreme Court would read Donofrio v. Wells, a suit brought by a New Jersey poker player against his state elections officer, which laid out the charges in the hopes of nullifying the election.
Today at 8 a.m., they came. "If I'm going to be honest with you," said Bredow, sporting a floppy American flag hat that he'd promised on YouTube he'd be wearing, "I thought I might be the only person here." He had flown in from Georgia. The other fifteen to twenty people who cycled in and out of the small protest had traveled shorter distances—southern Pennsylvania, northern Virginia—but they felt they had to do something.
The "dual born citizen" claim is the latest (and maybe strongest) attempt by Obama conspiracy theorists to argue that he can't be president, but most of the people I talked to had questioned Obama's citizenship long before this. "I first heard about it from Phil Berg's case," said Julie Menge of Williamsburg, Virginia, referring to a case that alleges, among other things, that a 2007 state of Hawaii reproduction of Obama's birth certification is forged, and that Obama's paternal Kenyan step-grandmother Sarah was in the room when he was born. One protestor claimed that a mysterious Muslim imam blessed Obama's birth in Kenya, and that this fact would eventually be revealed, somehow. (He cited African Press International, a bizarre web site that claims it has, but will not make public, a tape of Michelle Obama ranting about racist media coverage of her husband.)
At 9 a.m., a black minister who would only give his name as Brother Pittman led a prayer circle and a recitation of the pledge of allegiance. Pittman, who lives in Silver Spring, came as a "representative of the Rev. James David Manning," a Harlem preacher who became an Internet legend for a February sermon in which he called Obama a "long-legged mack daddy" who was "born trash." "I've been shunned by members of my own family," Pittman said. "I tell them, do the research! Go online and look up the facts! This is all about openness and why Barack Obama won't answer questions about who he is."
There's nothing new at all about small, strange protests outside the court, whether or not the justices are at work. While the Obama protestors were praying, a group of 16 young Christians walked up to the other side of the Court steps, strumming a guitar and lighting candles before holding a pro-life prayer vigil. Police and tourists looked on and a very small group of journalists grabbed the Obama protestors for interviews. "This story is writing itself," said a Mother Jones reporter as he filmed the prayer circle.
The Supreme Court will announce whether it will actually consider the Obama lawsuit as early as today and as late as Monday. If (as expected) the Court tosses the suit, Bredow will start challenging Obama's legitimacy based on "foreign money that went into his campaign." Other protestors said they'd start contacting members of the Electoral College. Steve Brindle, who drove down from Pennsylvania, said he'd called his senators yesterday.
"There aren't a lot of people out here today," said Brindle. "There are a lot of people talking about this back home. Really, everyone's asking questions."

The angle they are taking is that Obama was not actually born in Hawaii, and that his 'original' Birth Certificate would show that.
The birth certificate Obama has produced is official, re-issued by the state of Hawaii. But it is not the original.
Hawaii at the time would issue a birth certificate to a child if the parents had residence in Hawaii in the past year, no matter where the child was born.
The conspiracy theory goes, the original may show place of birth as someplace not in the US, while the re-issue does not. So he would not be a 'natural' born citizen, and may have dual citizenship with the country wherever you believe he was born.
Obama has not granted permission for Hawaii to disclose his original birth certificate, in fact he is fighting it tooth and nail. Obama's position is that the re-issued certificate is all that is needed.

What 'sacredness'? Government operates under the rule of law. The paramount law in the U.S. is the Constitution, which states that the President must be a citizen. If Arnold Schwarznegger somehow got on the ballot and was elected president by 100% of the population in a 'fair and square' election, he still could not be President because he is not a citizen. Just like Obama could not be president - despite being elected - if it somehow turned out that he is not a citizen.
The right to challenge the results also stems from the Constitution - you know, the whole 'right to petition the government for a redress of greivances' thing. Now, it seems pretty obvious that these protesters have run out of options and are using the 'kitchen sink' approach to stopping Obama being president.
However as an attorney I take a very objective view of situations such as this. I try to strip away the rhetoric and name-calling and take a look at the genuine issue (if there is one).
I'd like to point out that I do not support these protesters one bit, and I voted for Obama, but I also believe in the Constitution. It's the foundation of our entire system of government.

Some questions have been raised, and I think I have some answers:
First, @Jim: read the line again; Amanda wrote "strongest" not strong. Big difference. The other challenges haven't warrented a review by the Supreme Court, this one has. Hence it is by definition the "strongest." But it most definitly is not "strong" to make it much further. Just because the SC agreed to look at it (they do this with hundreds of cases) doesn't mean they will hear arguements (which is only dozens of cases a year).
Second, @Island: Should the sky fall, and the SC gets anal probed by Kang and Kodos into overturning the election, but before the Electoral College casts their votes, the Dems would be able to replace Obama with whoever they want (Biden or anyone). I saw a Slate.com Explainer article on this awhile back. After the Electoral College casts their votes, and Obama is the winner, then the S**T hits the fan; we're in a constitutional crisis like no other before. God knows what's happens; which is another big reason why nothing will happen. The SC doesn't like to directly interfer in normally properly functioning democratic processes (2000 FL not withstanding).
Third, also @Island: FBI is in charge of background checks; they do them for anyone going before the Senate for confirmation. What has been reported by actual, fact checking organizations is that Obama's HI birth certifcate is in a vault in HI, probably next to everyone else's who have been born in the state. These "copies" aren't copies in the normal sense of the word, but official gov documents, just not the original that states kinda don't want to lose. Hence keeping it locked in a safe, to keep it, you know, safe.
Fourth, these people do have a 1st Ammendment right to petition the government, and that deserves to be repected, especially since there is a large majority who are calling them down. However, just because they deserve the right to petition, does not mean they are right (or sane). This is an incredable waste of time, especially considering all the (similarly crazy) issues that arose with McCain's own citizenship status. Lay off it people; Obama won, move on. Put your energies into the democratic process (not the judicial process) to get the policies you want. It's really that simple!

This media is finally being forced to cover this. The issue started with McCain. As far back as last February you can find an article in the New York Times accusing McCain of not being a "natural born citizen". McCain then produced all of his birth records for review by the Senate and after review they declared that under the law McCain was a "natural born citizen". http://www.opencongress.org/bill/110-sr511/text
At the same time questions were being asked of Obama. The press then like now have a blackout on any topic that may be negative towards him. If you look at the link you will see Obama was present for the vote on McCain. Did Obama take the time to stand up and say,"Ladies and Gentlemen, I have been asked this same question and would like you to review all of my records so that this question can be answered before the election. As a Constitutional attorney I understand the crisis that would result from an ineligible candidate being elected."
Instead Obama produced a worthless piece of paper to websites like factcheck, fighthesmears, and others. The problem is that even if the CERTIFICATION of Live Birth is authentic, it is not evidence in Hawaii of where a child was born. A person cannot get a drivers license of a passport with what Obama produced. Here is what the State of Hawaii says about the difference between a "CERTIFICATION" versus a "CERTIFICATE OF LIVE BIRTH". The Certification is not good to prove where you are born and requires a person to sign a release and have the State produce a Certificate of Live Birth.

This is a more complete record of your birth than the Certification of Live Birth (a computer-generated printout). So at this point in time no one except for Obama and some of his family really know where he was born. His stubborn refusal to sign a release and pay $12.00 has created a national crisis. And please do not keep saying the State of Hawaii has confirmed he was born in Hawaii. They have not. In a carefully worded release all they have said is that they are holding his original birth certificate, which the State can only release if Obama signs a release and pays the $12.00.
For example, Obama's half sister was born in Indonesia. The laws in Hawaii at the time allowed a Hawaiian citizen to register that birth in Hawaii within one year of the birth. So Obama's parents registered his half-sister’s birth in Hawaii, just like Obama. His sister can produce a Certification of Live Birth that would look almost identical to Obama's. Does that prove she was born in Hawaii? No.
All of the hospitals at the time would send a list of all birth registrations to the local papers to be issued in the local paper.
So why is it important to know where Obama was born? The laws at the time, and that would still apply to Obama, are such that if he was born in a foreign country he would not be a "natural born citizen". That would be due to the fact that his mother was a US citizen, his father a foreign national. Obama's mother would have had to live in the US for five years after the age of 14. She was several months short of that when Obama was born. So until Obama signs a release and pays the $12.00 there is only speculation because the Certification of Live Birth produced by Obama does not prove that he was born in Hawaii.
There are also the questions of whether Obama gave his US citizenship up in Indonesia, how he came to travel to Pakistan in 1981 when it was a no fly zone for US citizens. There is also the question whether Obama registered at colleges as an Indonesian citizen.
So Obama and the DNC have brought this on themselves. This has been an issue since at least last February. Obama and his legal team have sealed all of his records. Three law firms showed up for Obama and the DNC in the Berg case to fight the case on the technical ground that a citizen cannot ask a candidate this question. To date Obama has spent over $800.000.00 to protect his past and the production of a $12.00 birth certificate.
There are now upwards of 30 law suits filed around the country, five to the Supreme Court. One filed in California Sacramento Superior Court Case 80000096 by Alan Keyes the Independent Party candidate that was on the ballot. As he was on the ballot he will not suffer the technical challenge of lack of standing.

So when Obama was an infant, his family was so sure that he'd grow up and be president that they went to all possible extents not only to make sure he got American citizenship, but also covered up foreign birth and/or citizenship? Not knowing he would be elected President, dual citizenship would probably be an advantage and not something to try to hide at the time he was a baby. And he did have dual citizenship through his childhood and into his political career, where's the paper trail?f And why would he have put everything into the Presidency if he had faulty credentials, when any other position in the country would be open and he has more than enough talent to achieve them? A conspiracy to be President is so much harder to pull off than becomming CEO of a huge, powerful MNC. All signs regarding the citizenship "conspiracy" point to bullshit.
I have trouble believing that when Obama was still a baby his family would have had any reason to cover up his nation of origin. And if it were something more recent during his political career, there'd just have to be some dirt that Clinton or McCain could've dug up. The fact that this waited til after the election was over clearly shows me that Obama proved everything he needed to, and all his documents were sufficient.

It was issued almost 12 years after I was born, which is when I first needed it, in order to get a passport...and the fools at the passport office actually gave me one! HAH! The funny thing about all this is that John McCain was indisputably born on a U.S. Naval base in Panama -- which is clearly not a part of the United States. While the base was part of the now-defunct Panama Canal zone, which was established by the Hay Bunau-Varilla treaty in 1903, that agreement was in essence a rental contract between the U.S. and a newly-sovereign Panama, whereby the U.S. paid Panama $250,000 annually for the rights to the territory established in the zone. Whether that contract could be considered the basis of natural-born citizenship would probably be for the courts to decide -- but of course we aren't having that discussion because McCain lost and, in any event, he's white.

Two clarifications, SpeakSoftly. A) it's not Amanda, she just posted it; it was Dave Weigel of Reason who wrote it, I believe.
B) I don't think the fact that it was before the Supreme Court makes it "strong" or "stronger" or "strongest" - it just means someone ponied up the filing fee and the time to write the petition.
Of course, as you noted, simply having a first amendment right to do something doesn't make it reasonable or right.
And - not directed at SpeakSoftly - having a right to "petition for redress of grievances" does not really have a thing to do with Supreme Court review. They are going to immediately look for standing, and I suspect they will find that the petitioner has none.

Americans were FOOLED. Almost everything about Obama is FAKE, including possibly his birth certificate. The Obama image was manufactured by a very expensive campaign, financed with hundreds of millions of dollars, donated largely by U.S. enemies such as George Soros.

I'm a plaintiff in one of the federal lawsuits on the 'natural born' issue filed before the election, and I served the legal papers -- required in a California state lawsuit -- at the Senate offices of Obama and Biden recently too. If McCain had been elected, I'd be challenging his qualification under the "natural born" provision too. The person in this thread who claims McCain was born on a military base in Canal Zone is mistaken. McCain's birth certificate clearly indicates the city in the Republic of Panama where he was born. An open letter I'm sending to the 10 Electors in Maryland is available at AIPnews. AIP is a new national political party -- America's Independent Party. We're already the third-largest national party, behind only the Democrats and Republicans, in terms of the number of registered voters. And we're not satisfied with being third. There are no birth records for him in either of the Hawaiian hospitals. His relatives in Kenya state he was born in Kenya. His Kenyan grandmother stated she was there for the actual birth.
Bottom line: he can't prove he is a natural born U.S. citizen because he is not.

One need not agree with everything that Leo Donofrio argues to support some of what he claims. I think his case raises important matters, and that our nation would be well-served if the question of whether Barack Obama is a natural born citizen is resolved before the Electoral College votes are cast on December 15. Hawaii officials say they won't show the state records to anybody other than Obama without an appropriate court order. I think we had to produce more documentation to allow our children to play little league baseball than Obama was required to produce to get on the ballot in all 50 states as the nominee of the Democratic Party.
If Obama is a natural born citizen, I'll be glad to learn it. Not because I think he's a good choice for President, but because our Constitution will have been followed. If Obama is not a natural born citizen, I'll be glad to learn that too. What kind of blackmail would our President be subject to by somebody who had proof of his birth if it occurred elsewhere? I can't understand why so many folks seem so willing to let the Constitution be ignored in this case.

First of all, The title to your story is very misleading. The Donofrio's case has nothing to do with the whole birth certificate thing.
Fact: We know that the Framers recognized a difference between US citizens and natural born citizens.
We don’t need to look FOR the definition of natural born citizen.
We need to be looking AT the definition of a US citizen (which would be what is required to serve as Senator or Representative but isn’t quite enough to let one serve as President).
14th Amendment:
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
This gives the SAME type of citizenship to those who are either:
1. BORN in the United States
OR
2. NATURALIZED in the United States

A child BORN on US soil to two foreign parents is a citizen of the United States.

If they did not think the natural born/dual citizenship was an issue why then did they not just deny Cort Wrotnowski aplication as well? It has been DISTRIBUTED for Conference on December 12, 2008. The case is based on the same theory.
