Agreed. Let it be passed and go to the Supreme Court so we know once and for all.
Just like McCain-Feingold, Congress seems hellbent on punting to the courts. Once upon a time they used to seriously debate whether a bill was unconstitutional before passage. They seem operate now along the same lines as Peter "The Courthouses are Open" Nickles.
