You sorta had to know this was coming. Ever since news first broke in the Washington Post on January 29 that D.C. Council member and former mayor Marion Barry had failed to file his taxes for the 11 millionth time, our collective Spidey Sense told us that those same federal prosecutors who were pushing for jail time for Barry for violating his parole in 2007 would be back. Now the Post is reporting that prosecutors are once again seeking to imprison the "mayor for life."
Here's what's happened to date: Barry pleaded guilty in 2005 to failing to pay taxes from 1999 to 2004, for which he is still on probation. Then he failed to file his 2005 returns, and prosecutors wanted him thrown in jail because complying with all tax laws was a condition of his probation. But a judge threw out that request on a technicality. Now, Assistant U.S. Attorney Tom Zeno has filed a motion arguing that Barry's failure to file his 2007 returns (he did file in 2006) constitutes yet another violation of his parole, and that Barry should therefore be jailed.
Barry's parole was supposed to be up in about a month, but we're guessing this latest development at the very least calls into question whether that parole might now be extended.
Does anyone have a spare copy of TurboTax for Council member Barry?

D.C. Unemployment Rate Reaches 11.9 Percent

Great. Now he's going to start comparing himself to Jesus again. As if Jesus ever smoked crack, banged hookers, or wore a red bow tie.
He looks like a Davis DJ in that picture.
if he goes to jail...does that mean ward 8 gets a new council member? (pretty please, with sugar on top!)
Never stopped them from voting for a convicted felon before.
The more close-calls he has with The Man, the more of a martyr he is to his constituents!
wtf? jim graham and tony williams better get on him for copyright violation with that tie.
oh, and please, quality representation for our friends in ward 8 would be a nice gift.
In Councilmember Barry's defense, I believe he is wearing a tuxedo in that photo.
A tuxedo with a striped shirt that has a mandarin collar, topped off with a red bowtie? Jail time for fashion crimes at the very least.
That's another matter entirely, yes.
Best ever Geoff...best ever (liquid came out my nose when I read that!!!). Nice work.
Unfortunately, the man needs more rehabilitation than prison time could provide. While I'd love to see him serve time for his continued disregard of the law, I can't help but see this turn out with him getting another slap on the wrist.
Ward 8 could do so much better, but we're now into the generation of offspring who remember his first term as mayor, and the first summer jobs program, and are sold for life, no matter how much of a criminal sleaze Mr. Barry happens to be. And that's very sad, indeed, that the voters can't be realists. But this is DC, which is somehow exempt from reality. Pity, that.
It is sad that Barry is again in this situation. Ward 8 needs a fresh face with fresh ideas. If Barry is to succumb to this ordeal I say lets vote for someone that will truly hold the values of the residents of DC and ward 8.
Y'know, I could make a joke about "The Green Mile" and our super magical mayor-for-life, but that would be tasteless, and no one has ever accused me of being tasteless. AND LIVED!
D.C. is Barry - Barry is D.C.
i'm DC, and barry sure as hell has nothing to do with me, randy.
Au contraire, mon frere. Without Barry's forward-thinking policies of patronage, rampant corruption, and ignoring the crack epidemic, PG County wouldn't be the most affluent majority African-American suburb in America, thereby making downtown DC marginally safe for a whole generation of gentrifying honkies.
NoMa, SoFlo, NoCoHe, and yes, even BloMi owe their existence to the right honorable ANC rep from Ward 8. All he asks in return is a bag of screaming babies and to not have to file his taxes. A small price to pay, IMHO.
Calm down...just a joke. (Just like Barry)
Its like the old saying that cobblers children have no shoes. He was too busy spending our money to pay his share. So really, he is the victim here.
If he's in prison then I won't see him in line at the CVS this valentines day buying cheap roses and trying to pick up the 17 year old working at the pharmacy counter-- which could be a good thing. But I live for those anecdotes- so please keep him on the streets. He's like a 3D, walking, SNL skit, free for all to enjoy.
Though entertaining, he's not free!! We unfortunately pay him with DC tax dollars!
