Suspect in 9-Year-Old's Murder Found Dead in D.C. Jail

2009_0819_crimetape.jpg The man who was arrested and charged in the Nov. 14 killing of 9-year-old Oscar Fuentes has been found dead inside his cell in the D.C. Jail, according to a report from WTTG/FOX5. Josue Pena, 26, had been charged with first-degree murder in the death of Fuentes, who died after being shot through the door of his Columbia Heights apartment. The Washington Post reported earlier that paramedics had been called to the jail for a call of an unconscious inmate this afternoon. WTTG says Pena was found hanged inside his cell just after 1 p.m. He was pronounced dead later at Howard University Hospital, with the cause of death determined to be cardiac arrest by asphyxiation. The report also includes these details:

Pena told prosecutors he had a gun in his waist band, but it accidently went off as he walked up the stairs.

Court documents indicate police also found the murder weapon, a .22 caliber revolver at his uncle's home on Kenyon Street NW. One tenant at the home with a 2-week-old baby says the suspect was there Saturday an hour after the shooting looking for a place to stay.

WTOP says Pena's death is under investigation.

Something to be thankful for.

Wow. That someone else died should never be something to be thankful for. We live in a society that should value justice, not vengeance.

Seeing how this seems to be a suicide, vengeance really doesn't come into play. Yes, many may argue that the victim's family have been denied justice, but... eh, I prefer looking at this without any emotional conclusions. I will say, though, if I was in Pena's shoes, I probably would have done the same thing.

True. He was locked up in the D.C. Jail where suicide may well be 'self inflicted'. Had he been in the PG County Jail, suicide is often homicide; not self inflicted.

I was about to say, "Isn't 'suicide' in jail more of a P.G. County thing?" And wouldn't this sort of crime merit a suicide watch, or don't they do that anymore?

Convenient for the city; they don't have to put any more effort into this one. And the person who did kill Oscar may still be running the streets.

Nothing's perfect. Juries have sentenced innocents and let the guilty free.
The police did have witnesses and a gun, so it's not unlikely he'd have been found guilty by a jury, as it's not unlikely that this suspect convicted and sentenced himself.
You can either choose to believe something like that, or you can choose to believe something along the lines of: the police arrested the wrong man, planted a gun in his family's home, and then somehow caused his death.
Which one is more likely?

The Constitution would be PERFECT if we could just get rid of that stupid f**king Bill of Rights. Those first Ten Amendments were a big mistake. A real slippery slope. First, everybody talking $h!t and then you get guns everywhere and then they ban liquor. And you can't even quarter troops in peoples' homes without permission? WTF? How the f**k are we supposed to fight terror with our dicks tied behind our backs? Stupid rag's been nothing but trouble.
