Good morning, Washington. For those of you who love to follow the latest antics of Virginia Attorney General Ken Cuccinelli, an update from the Post: the Obama administration has filed a motion to dismiss Cuccinelli’s health-care reform lawsuit, citing Congress’s authority to regulate interstate commerce. ‘In a statement, Cuccinelli conceded that federal laws generally trump state laws, but he said the conflict between the federal law and Virginia’s statute gave him a “duty” to file suit.’ Cooch has until June 7 to file a response.

Council to Consider Commuter Tax for City Employees: With Wednesday’s budget votes looming, the Washington Times takes a closer look at Harry Thomas, Jr.’s proposal to enact a commuter tax on all D.C. government employees who live outside the city limits. School Bus Driver Arrested for Making Child Porn: Words no parent wants to hear associated with their kid’s school bus driver: “inappropriate contact” and “child pornography.” The Examiner reports on the arrest of Prince George’s County school bus driver Scott Smallwood, 27, who police say left a memory card behind at a convenience store that turned out to contain videos of Smallwood molesting a 7-year-boy from his bus route. The victim reportedly told police that Smallwood had him over for sleepovers, and Smallwood has admitted having inappropriate contact with the alleged victim.
