Former Ward 5 Councilmember Harry Thomas Jr. could spend nearly four years in prison when he is sentenced Thursday for stealing more than $353,000 from a District program earmarked for youth sports.

U.S. Attorney Ron Machen asked a federal judge Friday evening that Thomas, who pleaded guilty in January, be sentenced to 46 months, WAMU reports. Federal sentencing guidelines recommend a sentence of between 41 and 51 months.

Since pleading guilty and resigning his seat on the D.C. Council, Thomas has struggled to repay the funds he stole from the Children and Youth Investment Trust Corporation and used to spend on lavish vacations, golf outings and luxury vehicles for himself. (And exotic shoes!)

Citing guilty plea and history of community service, though, Thomas’ attorneys are asking for a lighter sentence of 18 months, WAMU reports. And while Thomas read a deeply remorseful statement moments after his guilty plea, he has since January struggled to make the scheduled repayments he agreed to. He paid back $20,000 in March, but still owes more than $300,000 in addition to back taxes that District Attorney General Irv Nathan is seeking.

Meanwhile, Councilmember Jim Graham (D-Ward 1), who oversees the CYITC, released his report into the program on Thursday. Graham, the City Paper reported, will have subpoena power to determine if Thomas’ embezzlement was aided by anyone working for the agency. But both Mayor Vince Gray and Nathan told the City Paper that Graham having subpoena power in his investigation—the fourth into Thomas’ actions—is unwarranted.
