Former D.C. Council Chair Kwame Brown got away with only a day in custody and some time under house arrest for his guilty plea to a charge of felony bank fraud last year. His brother, though, wasn’t so lucky.

Che Brown was sentenced today to three months in prison for the same charge. Being the second time he had been found guilty of fraudulently obtaining a bank loan—the first time was in 1995—Judge Amy Berman Jackson didn’t seem inclined to let him go free. After he completes his sentence, he will be put on five years of probation and be required to perform 200 hours of community service.

Ironically enough, it was the investigation into his brother’s own bank fraud that led to Che’s second charge. According to the government, he claimed to be making $35,000 more than he actually did, allowing him to refinance his mortgage and save $717.44 a month.
