Metro announced today that they made an arrest in the case of sexual battery on a train near the West Falls Church station. Metro Transit Police have arrested Nathaniel Tyrone Ford on charges of indecent exposure more than 10 times since 2015, but Metro says it cannot bar him from the transit system.
In total, he’s been arrested more than two dozen times both on and off public transit, according to WMATA.
The victim of this latest incident was able to identify the 29-year-old Ford, having already been the target of a similar incident that occurred in January of 2016, Metro said in a release. Ford also has 11 arrests for fare evasion under his belt, according to WMATA.
About 20 percent of people say they’ve experienced sexual harassment on public transportation in the D.C. area, more than half of whom say it occurred on Metro trains or in stations.
But unlike in some other transit systems around the country, the only way that Ford or other people with a pattern of arrests for such behavior could be banned from Metro is via a “court-issued stay away order,” WMATA says.
The arrest was made in Fairfax County, where a judge would make the call about issuing such an order—though they rarely issue stay-away orders for the entirety of the system.
