The group of parents who brought the lawsuit say they will appeal the decision to the Supreme Court.

Parents had accused Fairfax County Public Schools of deliberately withholding notification of students who received National Merit Letters of Commendation. Virginia’s attorney general had launched a separate two-part investigation.

The final resolution affirms the schools’ commitment to inclusive teaching, but took out references to “equity” and “antiracism.”

Since April, all students enrolled in Fairfax County Public Schools have had access to free 24/7 online tutoring.

Schools have a lot to contend with as they return to daily in-person instruction: the transition from virtual learning, student social and emotional needs, and the regional surge in coronavirus cases.

More than 109,000 students and staff in Fairfax County are back for in-person instruction this week.

The charges follow a nearly year-long investigation into reports of abuse by a former teacher last October.

Superintendent Scott Brabrand extended by five days the deadline for families to choose between virtual learning and a hybrid model with some in-person instruction.

Looks like schools, for those that already have opened for the new school year, will be in session come Monday.
