If you’ve ever ridden a bike, you know that there’s nothing worse than the primal fear that strikes deep down when you see a driver throw open their car door only feet ahead of you. One Virginia legislator now wants to make it a offense worthy of a fine that could reach $100.
Fairfax Senator Chap Petersen has introduced a measure that would prohibit drivers from suddenly throwing open their door into a lane of traffic:
No person shall open the door of a motor vehicle on the side adjacent to moving traffic unless and until it is reasonably safe to do so. Nor shall the person keep the vehicle door open for longer than is reasonably necessary to load or unload passengers.
A violation of this section shall constitute a traffic infraction punishable by a fine of no more than $100. No demerit points shall be awarded by the Commissioner for a violation of this section.
The provisions of this section shall not apply to any law-enforcement officer, school guard, firefighter, or member of a rescue squad engaged in the performance of his duties.
Virginia currently has no law on the books prohibiting dooring, while both D.C. and Maryland require that drivers look before they open their doors into a lane of traffic that could be used by cyclists.
Petersen’s proposal will be considered by the Virginia General Assembly when it convenes next week for its annual legislative session.
