A Maryland gay man’s legal battle to keep his family together, is taking another step forward. According to 356Gay.com, Maryland’s Court of Appeals will hear Hedberg’s appeal to retain custody of his son and continue living with his partner, after overturning a lower court court ruling dismissing Hedberg’s complaint aganist a Virginia court ruling requiring his partner, Blaise Delahoussaye, to move out of the family’s home. A Montgomery County judge dimissed the complaint without giving Hedberg’s lawyers a chance to present evidence.

Back in April we covered the case of Ulf Hedberg — a gay dad locked in a custory case with his ex-wife. When we last checked in on the story, the case had moved from Virginia to Maryland, and Hedberg had asked the state’s second highest court to disolve a court order — originating in Virginia, of course — requiring his partner to move out of their home in order for Hedberg to retain custody of his son. Hedberg’s wife obtained the court order because she objected to the presense of Hedberg’s partner in the home, due to his role in the break-up of her marriage.
