I must confess I have a ulterior motive for picking this photo. Last week I read a blog entry from David Byrne (yes, that David Byrne) about Fatboy Slim and photo rights and was surprised to learn that in the UK, “an anonymous person photographed in a crowd tacitly gives their consent if they smile at the camera.” This obviously is not the case in the U.S., but Byrne poses some questions about the interaction between art and law (with examples) that I thought some of you might enjoy reading since I know this is a contentious issue around here at times.
