UPDATE: Quick work by the Council! (Hey, maybe they all wanted to go get in line at Shake Shack.) After introducing the bill, Cheh and Tommy Wells had a brief back and forth regarding punishments for ducking the subpoena (basically, anyone doing so would be held in contempt), then the bill passed.
There’s a legislative meeting of the D.C. Council at 11 a.m. today — but there isn’t a whole lot on the agenda. In fact, there’s only one item: an emergency bill to take Sulaimon Brown, Cherita Whiting and Peyton Brooks to court.
Councilmember Mary Cheh (D-Ward 3) will introduce the “Enforcement of Subpoenas of Sulaimon Brown, Cherita Whiting, and Peyton Brooks Emergency Declaration Resolution of 2011,” a bill which would allow the government to take legal action against Brown and Whiting, who were served a subpoena to testify at a May 13 hearing but never showed up. (The bill would also authorize the Council to take Brooks to court because they believe that his invocation of the Fifth Amendment is not legitimate.)
Brown has told media outlets that he didn’t receive the subpoena, despite Cheh’s claims that he signed for it via certified mail. (Whiting, meanwhile, appears to have just ignored the summons.) As the Examiner’s Freeman Klopott notes, it should be interesting to see how the Council responds to the bill; it’d be a massive surprise if the measure didn’t pass, though Councilmembers close to Mayor Vince Gray could well speak up regarding the measure before casting their vote.
