Update: On February 2, D.C. Police identified the man as 36-year-old Peter John. He had no fixed address, according to a release.

A man is dead after being shot by a police officer in Northeast today, NBC4 reports.

The shooting happened around 2 a.m. this morning on the 5300 block of Clay Terrace NE. The officer attempted to stop the man and a brief foot pursuit and struggle ensued, according to an MPD release. During the struggle, the suspect “failed to comply with the officer’s commands and produced a firearm,” causing the officer to discharge his weapon. The suspect’s weapon was later determined to be a BB gun.

After being shot, the man was taken to a local hospital and pronounced dead, according the release. Police have not released his identification, as next of kin are being notified.

The officer sustained no injuries. Authorities are investigating, according to a tweet from MPD.

A report released last week showed that despite some “significant deficiencies,” D.C. “remains best in class” regarding police use of force.
