A viral video from a Federal Triangle bar and restaurant has caught the attention of local authorities.

Conservative author and podcaster David Harris Jr. posted the clip Tuesday night. It shows patrons at Harry’s chanting “back the blue” as four MPD officers walk through the establishment. Harris, who isn’t wearing a mask, thanks them for their service. Many applauded the show of support and said this is how America should treat police right now. The post even garnered a retweet from President Donald Trump. Others were outraged at the scene of a maskless crowd indoors during a pandemic.

A spokesperson for the Alcoholic Beverage Regulation Administration (ABRA), which handles Mayoral Order violations, says the “matter has been assigned for investigation.”

Several potential Phase 2 Mayoral Order reopening rules appear to be violated in the video, including mandates that “all guests must be seated” and “no standing at bars is allowed.” The rules also say guests should wear face masks or coverings indoors at all times except for when eating or drinking.

While the bar looks crowded, it’s unclear if that is a violation. ABRA says indoor dining occupancy must be limited to 50% of the seating capacity on the certificate of occupancy.

Many of the offenses carry a warning or $1,000 fine for the first offense, a $2,000 fine for the second offense and a meeting with the ABRA board for the third offense. ABRA has investigated more than 130 incidents of violations during the pandemic.

D.C. police are also tasked with enforcing the Mayor’s Orders, according to the order. It’s unclear why the police were there or if they enforced the rules before or after the video. In July, Mayor Muriel Bowser said if businesses see mask violations, “they should call the police and the police will enforce it.”

A spokeswoman for D.C. police said she believed officers were getting takeout food from Harry’s, but couldn’t confirm “the exact circumstances based on this short video.”

Harry’s did not immediately respond to a request for comment via email.

Harry’s has been investigated twice before for violating pandemic rules. Once on July 3 for insufficient spacing between tables, which resulted in a verbal warning, and once for violating alcoholic beverage take-out rules. ABRA later ruled “no violation found after review of MPD footage.”

Raman Santra, a lawyer who runs the D.C. nightlife account Barred in DC and has tracked violations, says “it’s highly unlikely to me that Harry’s will be fined or worse just based on that video. ABRA is probably getting hundreds of complaints right now though so there’s no chance they will not make a visit this week to see how they’re complying.”

This isn’t the first time Harris went viral during the pandemic. In August he posted a video of his encounter at a Dallas airport in which American Airlines tells him that he’s banned from future flights for not wearing a mask.

The bar has been popular with police for years and in recent years has drawn conservative and white supremacist patrons like the Proud Boys thanks to its proximity to the Trump Hotel.
