The family of one of the 12 people killed during the Navy Yard shooting spree plans to file a lawsuit against the U.S. government for negligence.

Mary D. Knight was one of 11 people killed when Aaron Alexis entered the Naval Sea Systems Command headquarters in September and opened fire in Building 197. Alexis, who had documented mental health issues, was fatally shot by police. Knight’s family will file the suit in Tampa, Fla., where the IT specialist used to live. From WTVD in North Carolina:

Justin Givens, a Florida-based attorney, said Mary D. Knight’s family will make the announcement and file suit later this morning in Tampa where Knight used to live.

“The gist of our lawsuit is there was a colossal (security) failure on behalf of the Department of the Navy and of the Federal Government and the Experts, the private security company used (by the government),” Givens said.

Givens said the 34-year-old shooter, Aaron Alexis, had a well-documented criminal and mental health record that the Veterans Administration chose to ignore after visits to the facility earlier in the year.

Knight’s family is seeking $37.5 million, according to the Washington Post. They filed an administrative claim today against the Department of the Navy and the Department of Veterans Affairs, which is needed before they can file a lawsuit in federal court.
