Neil Prescott, the 28-year-old Maryland man accused of threatening to a Colorado-style rampage at his workplace, has been charged with misdemeanor telephone misuse, reports the Washington Times.

Wait, telephone misuse? Yep. Apparently those 25 guns he was found with were all legally registered, and the most Maryland officials could charge him with was a misdemeanor that could land him in jail for three years and slap him with a $500 fine.

Prescott made the threats while speaking to a co-worker over the phone after having been fired from his job at Pitney Bowes; he said, “I am a joker; I’m gonna load my guns and blow everybody up.” The reference to the joker pushed police into obtaining a warrant to raid his home, where they found the guns and a stockpile of ammunition. He was found wearing a t-shirt that said, “Guns don’t kill people, I do.”

Prescott remains in a hospital undergoing mental health evaluations. Police said he had shown no past history of mental illness.
